Appeal court strikes out Gombak voters’ suit against Azmin

THE Court of Appeal today agreed to throw out a case filed by Gombak voters against their MP Mohamed Azmin Ali over breach of fiduciary duty.

After hearing submissions from both sides, a three-man panel chaired by judge Yaacob Md Sam approved Azmin’s application to strike out the complaint.

Lee Heng Cheong and Hashim Hamzah were the two other judges who heard the appeal.

On November 27 last year, 10 registered voters in the Gombak parliamentary seat sued Azmin over his role in the infamous “Sheraton Move,” which led to the fall of the Pakatan Harapan government in February the same year.

Messrs Yohendra Nadarajan filed the suit for the plaintiffs in the High Court.

The suit sought a declaration that Azmin, as the Gombak MP, had breached his fiduciary duty and deceived the voters in the 2018 elections, among others.
 
The plaintiffs said that the Gombak MP had duped the people by courting them with the promise of ousting Barisan Nasional from power but had subsequently aligned himself with the Perikatan Nasional government.

The High Court had in March last year denied Azmin’s application to have the suit dismissed and had set June 7-10 for a hearing. – April 13, 2022.
