FORMER prime minister Najib Razak has filed an application to stay his SRC International Sdn Bhd trial, which is scheduled to begin on Tuesday.
His lawyers said the stay application was filed at the Court of Appeal registry today, together with a certificate of urgency calling for the bid to be heard on Monday, a day before the trial is due to start.
One of the lawyers told The Malaysian Insight that the public perception that Najib is trying to put off the trial is wrong.
“The appeal is because the decision to try the case at the high court is not right. It should be brought back to the sessions court, and is for the high court registrar to decide.
“The appellate court needs to decide whether the matter can be heard at the high court. We don’t want to risk the trial becoming null and void.”
Najib is seeking to stay the trial for seven corruption charges involving SRC International funds amounting to RM42 million, pending the outcome of the appellate court’s decision on his appeal relating to the withdrawal of a certificate of transfer by the public prosecutor.
High court judge Mohd Nazlan Mohd Ghazali yesterday allowed an application by Attorney-General Tommy Thomas to withdraw the certificate to transfer the seven charges from the sessions court to the high court.
Najib then filed an appeal in a bid to set aside the high court ruling granting the withdrawal of the certificate of transfer.
On July 4 last year, Najib was charged with three counts of criminal breach of trust and one count of abusing his position in relation to the SRC International funds.
On August 8, he was charged with three counts of money laundering involving the RM42 million. – February 8, 2019.
