FORMER prime minister Najib Razak and former 1MDB chief Arul Kanda Kandasamy were charged separately at the Kuala Lumpur Sessions Court today with altering the auditor-general’s report on 1Malaysia Development Bhd before it was confirmed and tabled to the Public Accounts Committee (PAC).

According to the charge sheet, Najib committed the offence between February 22 and February 26, 2016, at the Prime Minister’s Department Complex in Putrajaya.

The charge sheet said Najib used his position as prime minister to get “protection from disciplinary, civil or criminal actions for matters related to 1MDB” by ordering amendments to the audit report.

He committed an offence under Section 23(1) of the Malaysian Anti-Corruption Commission Act 2009 (Act 694), and can be punished under Section 24(1) of the act if found guilty.

Najib was represented by lawyer Muhammad Shafee Abdullah.

Judge Azura Alwi set bail at RM500,00 and ordered it be posted today.

Shafee had asked that the amount be paid in three instalments of RM200,000 another RM200,000 and RM100,000.

He said this was done in the other cases.

Azura denied the request and said bail must be paid today.

Public prosecutor Gopal Sri Ram asked if the case can be mentioned together with Arul Kanda’s case on January 4 and Azura agreed.

In the second courtroom, Arul Kanda claimed trial after he was charged with abetting Najib in the offence, on the same day and time, at the Prime Minister’s Department Complex in Putrajaya in 2016.

He was allowed bail of RM500,000 and ordered to surrender his passport.
