Ex-Kelab PJ veep mulls legal action over expulsion

A FORMER Kelab PJ vice-president is mulling legal action against the club for suspending him for attending an extraordinary general meeting (EGM) on May 2.

The club management expelled Ragavan Rajoo for seeking legal redress after it had suspended him.

Ragavan told The Malaysian Insight he has met with lawyers and is currently contemplating further legal proceedings against the club committee. 

“I am looking into challenging the expulsion.”

Ragavan said he received the expulsion letter on Friday after initiating legal action against the club.  

In the letter, the club’s general committee said that during their meeting on December 17, the members reached a unanimous decision to expel Ragavan.

The reason, they said, is because Ragavan had raised the issue of the EGM with the Registrar of Societies (ROS) and sued the club. 

On Friday, Ragavan obtained an interim order from the Shah Alam High Court to stay the club’s annual general meeting scheduled for Saturday. 

He said the court then granted the stay order involving the alleged illegal EGM on May 2.  

Ragavan said the court will hear their arguments on the matter on February 2 next year. 

Ragavan is among 56 Kelab PJ members calling for their two-year suspension for attending an EGM on May 2 to be lifted.  

They said Selangor ROS had sent a letter to the general committee advising them to cancel the suspension. 

The members were suspended effective November 29, with notices sent out by the committee.

They also said the EGM the members attended on May 2 was not illegal and in line with the club’s constitution.

Kelab PJ vice-president Mohd Taufik Sri Abdullah said Ragavan was expelled because he did not follow the club’s constitution.

“As the former vice-president and disciplinary head, Ragavan should know the constitution of the club.  

“He should know what can be done and what can’t be done. But, he went overboard and that’s why he got expelled.”

Taufik said they feel that a suspended member has no locus standi to initiate legal action against anyone.  

“In our constitution, it says if a member has been suspended he has 30 days to call for an EGM on his suspension, but he went straight to the courts.
