Kelab PJ members want suspension lifted

FIFTY-SIX Kelab PJ members in Petaling Jaya, Selangor want their two-year suspension for attending a legitimate requisition extraordinary general meeting (EGM) to be lifted.

They said the Selangor Registrar of Societies (ROS) has sent a letter to Kelab PJ’s general committee (GC) advising them to cancel the suspension.

The club members told The Malaysian Insight that they were suspended effective November 29 with notices sent out by the GC.

They also said the EGM the members attended on May 2 was not illegal and in line with the club’s constitution.

Kelab PJ vice-president Ragavan Rajoo, who has also been suspended, said the GC is aware of the letter ROS has sent.

“What we heard is that the GC is of the opinion that it does not need to act on the recommendations made by ROS, but the 56 members want the GC to abide by ROS’ recommendations,” he said.

Ragavan said they are contemplating applying for a court order as ROS has said the postponement of the EGM was not according to procedure.

“As such, the suspension of the members should be lifted and they be allowed to attend the AGM (annual general meeting) on December 18,” he said.

“We are confident of getting the court order.”

He said the ROS letter states that the EGM and the suspension of the members are not valid because notice of the postponement of the EGM was given too late (15 hours before the meeting).

He said ROS suggested that Kelab PJ cancel the suspension and allow the members to attend their AGM on Saturday.

He said after the EGM, they got two legal opinions, while the GC also got one on the matter (EGM).

“All three opinions concurred that the EGM was valid and held according to our constitution,” he said.

“We got all the legal opinions within a month of the EGM.”

According to the suspension letter issued by the GC, the committee said that on May 1, they had postponed the EGM due to the sudden rise in Covid-19 cases.

The letter stated that seven members of the GC had agreed to postpone the EGM until further notice.

The GC also said the members went ahead with the EGM without their presence, deeming it to be illegal and an unauthorised meeting.

Ragavan said only when the offence is of a serious nature can the GC refer the member for a disciplinary hearing.

“In the interim, the GC can suspend a member for a period of three months and a further three months pending completion of the disciplinary hearing,” he said.

“As far as we know, there was no investigation nor was there a disciplinary hearing.

“As such, the GC had acted ultra vires the constitution in suspending us for two years after only having requested the members to answer a show-cause letter.”

Ragavan urged the GC to give them the opportunity to attend the AGM where they hope to raise the suspension to the floor and let the members decide.

“If we are voted down, then we will accept it,” he said.
