City Hall will see legal battle with residents to the end, says minister


CITY Hall will let the law take its course in the matter of its court battle with Taman Tiara Titiwangsa residents, said Federal Territories Minister Khalid Samad.

He said City Hall has a right to appeal a court ruling just as the residents have a right to fight the local authority over a decision.

“I feel that this issue can be discussed between City Hall and the residents’ associations.

“If they want any amendments we can discuss it. But since they have brought it to court we will see through the legal process to the end,” he said at City Hall headquarters today.

City Hall filed to the Federal Court for leave to challenge the decision of the Court of Appeal that a public hearing was null and void as it did not adhere to Rule 5, which is designed to allow public participation in local government planning and development control.

“This is not a political issue. The law is the same whether it’s Barisan Nasional or Pakatan Harapan governing the country.”

The Save Kuala Lumpur Coalition in a statement said that Pakatan does not need a court decision to do the correct thing or practise good governance.

“They often attacked BN for not practising it in planning and development control.

“Yet even after being told to practise it by the Court of Appeal, they want to appeal against this decision to the Federal Court.

“This means they want to continue with the BN policy of not giving Rule 5 objectors the traffic impact assessment, social impact assessment, environmental impact assessment and other vital documents and allow City Hall to chair hearings involving applications for development orders for lands which are owned by the Federal Territories Foundation, whose board members include the mayor and the FT minister.” – April 30, 2019.
