Coroner rejects application to recall expert witnesses in Adib inquest

THE Shah Alam coroner’s court today rejected an application to recall Kuala Lumpur Hospital pathologists Dr Ahmad Hafizam Hasmi and Dr Mohd Shah Mahmood following conflicting testimonies on fireman Muhammad Adib Mohd Kassim’s injuries.

Coroner Rofiah Mohamad said the inquest won’t move forward if the two expert were to be called again.

“The two will give the same explanation and the same statements.

“There is no need to call them as it will not change the findings that have been recorded by this court and if we call the two doctors, then we might probably call again Prof Shahrom (Abd Wahid) and the case will drag on,” Rofiah said.

“I am satisfied with the findings in this inquest, therefore, there is no need to recall Dr Shah and Dr Hafizam,” she added.

The application to recall the duo was made by conducting officers after the testimony of their witnesses were disputed by another expert witness – Shahrom – last week.

Following the coroner’s ruling this morning, deputy public prosecutor Hamdan Hamzah said he will appeal against the decision at the Shah Alam High Court later today.

Rofiah then set May 10 as the mention date for the inquest.

Hamdan argued yesterday that the inquest should recall the two pathologists after Shahrom revealed that fireman Adib was assaulted by a mob during the riot at the Sri Maha Mariamman temple last year.

Shahrom last week explained that Adib was assaulted by at least two attackers during the riot and his findings were based on an independent experiment he conducted.

The findings are different from Hafizam and Shah’s who both agreed that Adib was not attacked but had sustained severe injuries after he was accidentally hit by an EMRS van.

Another witness, investigation office ASP Lew Keng Joe, also previously testified that he does not believe that Adib was assaulted based on the injury marks on the fireman’s body.

Adib, a member of the Subang Jaya Fire and Rescue Department’s Emergency Medical Retrieval Service unit, was seriously injured while responding to riots at the temple in USJ 25, Subang Jaya, on November 27 last year. He died on December 17 in the National Heart Institute. – April 23, 2019.
