Rosmah has 7 days to confirm whereabouts of jewellery

ROSMAH Mansor has one week to confirm the whereabouts of 44 pieces of jewellery sent to her by a Lebanese company, ruled the Kuala Lumpur High Court.

The jewellery, worth US$14.79 million (RM60.21 million), was seized by police shortly after the 14th general election.

Judicial commissioner Wong Chee Lin made the order in chambers today.

Lawyer David Gurupatham, representing Global Royalty Trading SAL, told reporters that the court ordered Rosmah, the wife of former prime minister Najib Razak, to find and inspect the jewellery within seven days.

“The court also ordered Rosmah to confirm whether the goods are actually there.”

He said the judge noted that Rosmah had received the jewellery because there was a consignment note, and it is up to her to prove where the jewellery is, and not his client.

“Rosmah said she received the goods, and confirmed it. Of course, the goods were requested by her and sent to her, and she even signed the consignment note.

“Now, she is saying since the goods have been seized by police, she does not have to pay for it.”

On Tuesday, the court was told that police are still unable to determine whether they have in their possession the 44 pieces of jewellery, which are allegedly not paid for.

Federal counsel Shaiful Nizam Shahrin told the court that police cannot confirm whether the items from Global Royalty is part of the 12,000 pieces of jewellery seized in raids on premises linked to Najib last May.

He told the court that police are unable to confirm or clarify where the 44 items came from.

He said the government intends to file an application to stay the proceedings, pending confirmation from police on the matter.

Today, Wong fixed February 25 for the parties involved to file applications to stay the proceedings.

He also ordered the parties to be prepared for trial if an application for a stay comes through or is not granted.

Global Royalty is run by Lebanese-American Samer Halimeh, who filed the suit against Rosmah last July, demanding the return of the 44 pieces of jewellery that were sent to her for viewing purposes, or the full payment for the items.

Last October, the court ordered the Malaysian government and attorney-general to confirm whether they have in their possession the 44 pieces of jewellery.

In the affidavit filed by former Commercial Crime Investigation Department director Amar Singh Ishar Singh, who led the raids on the Najib-linked premises, he said police seized the jewellery.

In a subsequent affidavit, police said they are unable to confirm whether they seized the 44 items.

The trial is set to proceed on March 4 and 5. – February 14, 2019.
