Documents to develop Taman Rimba Kiara binding, says FT minister

DOCUMENTS signed by former federal territories minister Tengku Adnan Tengku Mansor and a developer to turn Taman Rimba Kiara into high-rise condominium blocks are legal and binding, Khalid Samad said.

The Federal Territories Minister told this to a disappointed crowd of more than 500 Taman Tun Dr Ismail residents at a town hall meeting tonight.

He said the 4.8 ha park was rezoned in 2013 by Kuala Lumpur City Hall (DBKL), and Yayasan Wilayah Persekutuan had applied for the land.

“The land is owned by the FT Ministry and was to be turned into a mixed development. They had to pay RM60 million premium to develop it.

“This agreement is formal, official and it is a binding agreement. The developer has said he will give up the land, but we have to pay them back RM155 million,” Khalid said.

For more than a year, TTDI residents have been campaigning to save Taman Rimba Kiara from development and are up in arms over the recently gazetted Kuala Lumpur City Plan 2020, which shows that the park has been rezoned with the possibility for future development.

They said Khalid had failed to keep his promise to consult them before the plan was gazette, and are alarmed over deviations from the KL Draft Plan 2008, in which Taman Rimba Kiara is zoned as a public open space. 

Khalid said the area that was once open space has been rezoned and is now for mixed development.

“Technically it was not wrong, because at that time (2012), the plan was not gazetted. 

“Ku Nan said he didnt want it gazetted because he said it was outdated.

“KL City Plan 2020 was never gazetted, and I’m the first to gazette it.”

Khalid said even Prime Minister Dr Mahathir Mohamad has taken notice of the Taman Rimba Kiara issue. 

“He has sent a letter asking why this issue hasn’t been resolved. I have answered as to why and that there are negotiations that are taking place.”

Khalid said going to court would be pointless because the development order has been signed.

“The land is in the possession of the Federal Territories Foundation.

“They could sue us for the money they had spent on the premium, consultants and other issues, and for lost of profits.

“I can’t change what had happened in the past,” he said. 

Khalid said corruption can occur and it is through two ways, which is rezoning and increase in density. 

“They (developer) see an open space, they offer (the authorities) money to rezone. 

“They also can change the plot ratio. It can still happen, but it will have to go through a meticulous approval system.” 

Segambut MP Hannah Yeoh said that they will set up a joint working commitee with the Federal Territories Ministry and the residents association to solve the issue. β€“ November 23, 2018.

  • Sue them for fraud, surely. Any contract that is against public policy is void. After all, the original act stemmed from corrupt practices (said minister charged) and what ensued also can be challenged in court of law.

    It would be worth digging how much the developer paid and to who. Clearly the act of converting the land use then to sell on to 3rd party for quick profit (instead of for public benefits) is suspicious.

    And if the price is paid at a rate that smells fishy, there can be ground for lawsuit

  • Rubbish . Nationalise the land and haul up the idiot Ku Lan and ask him to pay off the developer. If the developer is still trying to be funny, black list and see if in future they will have any more projects in their hand. Stop being a hypocritic angel and palying saintly with being political correct. It is getting revoting that PH is going in that direction for all Umno grave concerns. Political correctness in ensuring the care and welfare of rakayat are welcome but when it is detrimental and against the greater good, drop all that bull shit and unwarranted charade.!!!!!!!!!!!!!!!!!
