Pupil wins RM43,000 damages for assault by teacher

IN an unprecedented ruling, a pupil has been awarded RM43,000 in damages by the Shah Alam Sessions Court for injuries she sustained after a teacher hit and slapped her two years ago.

Judge Noor Ruzilawati Mohd Noor found the teacher and school responsible for assault and battery on R. Nivedha Nancy Ann, 15.

Nivedha filed a police report against the teacher through her father R. Ramesh in 2016 and subsequently initiated a civil case.

In yesterday’s judgment, the judge awarded RM40,000 in aggravated and exemplary damages, RM3,000 in general damages, and a further RM203 in special damages.

Her lawyer V. Satchitanandan also received RM17,000 in costs.

In May 2016, Nivedha was slapped twice by Azmani Akhbar before she was hit with her own school shoes by the teacher.

The incident happened at about 4pm as she was about to sit for an exam.

Nivedha sustained “soft tissue injury” and bleeding in the ears due to the assault.

Doctors at Serdang Hospital confirmed the injury.  

However, Azmani was acquitted by the magistrate’s court last year for the assault.

Prosecutors have filed an appeal in the high court. – November 20, 2018.

  • Prosecute the teacher and jail the teacher. If the court had awarded damages to the student, then obviously the teacher has to be charged for causing hurt.

  • Bravo! This should serve as a grim reminder to those violence-prone teachers (and there are many in schools) that a precedent has been set by the courts. The next time one of these hoodlums (both men and women) raises a hand against vulnerable schoolkids, the long arm of the law will not be found wanting. Guru Besars who shield these violent teachers should also be prosecuted.
