Cannabis oil case up to A-G’s Chambers

THE Attorney-General’s Chambers will decide the fate of Muhammad Lukman, who was found guilty of processing, possessing and distributing medical marijuana (cannabis oil), said Dr Dzulkefly Ahmad.

The cabinet has taken note of the issue and discussed the legalisation of medical marijuana, the health minister said. 

“We discussed the legalisation of medical marijuana, the cabinet has taken note. 

“But no decision has been made. Please wait for the decision from the cabinet.

“As for Lukman’s case, that will be the role of the A-GC,” he said at the Health Ministry today. 

Prime Minister Dr Mahathir Mohamad has indicated that the government could review the case of Lukman, who is sentenced to death for making and distributing medicinal cannabis oil.

Lukman was arrested in 2015 after police discovered 2kg of dry cannabis and 260g of compressed cannabis at his home.

He was handed the death sentence by the Shah Alam High Court on August 30.

Dzulkefly said they are not necessarily looking to amend the Dangerous Drugs Acts 1952, which was amended in 1980.

“But for this case, he is still due to go through Courts of Appeal and the Federal Court.”

The other matter of cannabis discussed by the cabinet was allowing its use in clinical research, he said.

“If used for clinical research and there are provisions, it is allowed with my endorsement. However, cannabis is still under the Dangerous Drugs Acts, so anyone found guilty, are still subject to the law.” – September 19, 2018.

  • As long as there is no proof that the marijuana oil is of actual medicinal value, then it is still considered as a narcotic. Moreover, the oil has not being medically proven to have any healing powers.
