JAILED de facto PKR leader Anwar Ibrahim has filed an application through his solicitors to compel Prime Minister Najib Razak and Umno lawyer Muhammad Shafee Abdullah to show their bank statements.
The application for discovery filed at the Kuala Lumpur High Court this morning follows whistleblower site Sarawak Report’s May 31 article that alleged Shafee received a total of RM9.5 million from Najib in 2013 and 2014.
Anwar’s lawyer Larheefa Koya confirmed that the application was to compel both men to reveal their financial statements in relation to the claim that Najib had paid Shafee, who was the lead prosecutor in the successful appeal against the acquittal of Anwar’s second sodomy charge.
“In the application, we asked that Najib and Shafee to produce their statements of accounts maintained by them at whatever banks during certain periods,” she told The Malaysian Insight.
The periods of interest are from August 2013 to October 2013, and from January 2014 to March 2014; particularly the entries for transactions made on September 11, 2013 and February 17, 2014.
Sarawak Report in its story had cited these dates as the days Najib allegedly transferred RM4.3 million and RM5.2 million to Shafee.
Both men have 14 days to produce the information upon being served the order.
The application is based on grounds that Shafee was the prosecutor appointed by the attorney-general to prosecute Anwar in the Court of Appeals and the Federal Court; and that the alleged payments to him by Najib “were at all times concealed from the relevant Courts and the plaintiff”.
“These payments render Shafee not an independent prosecutor,” the legal papers said.
Shafee had recently said he would respond to the allegation, but has yet to issue a statement.
Last week, Anwar also filed an application to set aside his sodomy conviction after the allegation of Najib paying Shafee money surfaced.
Anwar is currently serving a five-year-jail sentence for sodomy after his acquittal was overturned by the Appeal Court in 2014. – June 15, 2017.
