PAS will not appeal the Election Court’s decision in nullifying its Kemaman parliamentary seat win in the 15th general election, party secretary-general Takiyuddin Hassan said.
Takiyuddin said the party is ready and will wait for further announcement from the Election Commission (EC) on a re-election in Kemaman.
“PAS has decided not to appeal the court’s decision in nullifying the victory of PAS candidate Che Alias Hamid in Kemaman in the last general election.”
“PAS will wait for the announcement and is ready to take the next step based on any decision deemed necessary by the EC,” Takiyuddin said.
Last week, the court nullified Che Alias’ general election victory in the Kemaman seat in Terengganu.
Lawyer Amin Othman, who represented petitioner Wan Mohamad Hisham Wan Abdul Hamid, confirmed that his client succeeded in challenging the election win.
Amin said election judge Anselm Charles Fernandis had accepted his client’s allegations there had been bribery in several official Terengganu government events through the distribution of i-Belia and i-Siswa aid funds to voters during the polls campaign period to garner votes for Che Alias.
Amin said the judge’s decision was based on section 32(c) of the Election Offences Act 1954.
Under section 32, the election of a candidate shall be declared void on an election petition, if any of five situations are proven to the election judge’s satisfaction.
In the general election, Che Alias won the seat with a 27,179-vote majority after polling 65,714 votes.
Barisan Nasional candidate Ahmad Said, who is former Terengganu menteri besar, polled 38,535 votes while PKR’s Hasuni Sudin picked up 8,340 votes.
The fourth candidate, Pejuang’s Rosli Ab Ghani lost his deposit after polling 506 votes. – October 3, 2023.
