THE Attorney-General’s Chambers has yet to decide whether to review the criminal breach of trust (CBT) case against Najib Razak and Mohd Irwan Serigar, the High Court was told today.

Deputy Public Prosecutor Muhammad Saifuddin Hashim Musaimi told the court at the start of today’s proceedings that the trial dates would be fixed next year.

Former prime minister Najib and former treasury secretary-general Irwan face six criminal breach of trust (CBT) charges involving RM6.6 million of government funds paid to the International Petroleum Investment Company.

The two were charged in October 2018. They pleaded not guilty.

They allegedly committed the offences at the Finance Ministry complex in Putrajaya in 2016 and 2017.

The offences, under section 409 of the Penal Code for CBT by a public servant or agent, are punishable by 20 years in jail, whipping and a fine upon conviction.

Najib is represented by Muhammad Shafee Abdullah while counsel  K. Kumaraendran appeared for Irwan.

Najib, 70, is serving a 12-year jail sentence for corruption linked to sovereign wealth fund 1Malaysia Development Bhd (1MDB). He also faces several other graft charges.

Earlier this week, Najib was acquitted of audit tampering charges in connection with 1MDB. The AGC did not file to appeal the acquittal.

Last week the High Court discharged without acquitting Deputy Prime Minister Ahmad Zahid Hamidi of tax evasion and money laundering charges. – September 15, 2023.
