Zahid gets discharge not amounting to acquittal

THE Kuala Lumpur High Court today granted Ahmad Zahid Hamidi a discharge not amounting to an acquittal (DNAA) in his corruption trial.

Judge Collin Lawrence Sequerah made the ruling after listening to the prosecution’s submission.

He said the decision was made to allow further investigations by the Malaysia Anti-Corruption Commission (MACC).

Sequerah said the case was still open.

Zahid had made representations to the Attorney-General’s Chambers for the 47 charges against him to be dropped.

Sequerah said the decision also factored in the fact that a royal commission of inquiry had been set up to look into the allegations published in the memoirs of former attorney-general Tommy Thomas, particularly on selective prosecution.

“The representations are about 200 pages and it is justified for further examination to be conducted,” the judge said.

“As such, I make an order of discharge not amounting to an acquittal,” he said.

Earlier, head of the prosecution team, Mohd Dusuki Mokhtar had listed 11 reasons for offering the accused a DNAA.

Dusuki said a discharge would make way for the authorities to launch a comprehensive investigation. He also said there had been no miscarriage of justice in the case.

Zahid’s counsel Hisyam Teh Poh Teik had argued for a full discharge.
