Federal Court allows BN to challenge Masjid Tanah, Kemaman results

THE Federal Court has ruled that the general election results for two constituencies may be challenged by Barisan Nasional (PN), which alleged bribery on the part of Perikatan Nasional in claiming the seats last November.

A three-person bench chaired by Chief Justice Tengku Maimun Tuan Mat unanimously granted the appeals by two Barisan Nasional (BN) candidates: Abdul Hakim Abdul Wahid and Wan Mohamad Hisham Wan Abdul Hami.

The pair challenged the elections results of Masjid Tanah and Kemaman constituencies, won by Bersatu’s Mas Ermieyati Samsuddin and PAS’s Che Alias Hamid respectively.

The panel ruled that allegations of bribery in both cases must be heard before an Election Court, fixing the next mention of the Masjid Tanah case for Friday, and similarly the Kemaman case for Monday.

On February 7, the High Court in Malacca allowed ruled in favour of Mas Ermieyati, striking out Hakim’s election petition.

Six days later, the High Court in Terengganu similarly ruled in favour of Che Alias Hamid, striking out the election petition by Wan Mohamad Hisham. – May 2, 2023.
