Teacher sentenced to 6 months in jail for trespassing


A SECONDARY school teacher lost his appeal against a trespassing conviction today.

Mohamad Hassan Malek, 43, was ordered to begin a six-month jail sentence immediately for trespassing into the home of his aunt.

A three-member panel comprising Justices Hanipah Farikullah, Hadhariah Syed Ismail and Azman Abdullah dismissed his appeal.

Hanipah, who delivered the court’s decision, issued a warrant of committal for Mohamad. He had been on bail of RM10,000 with one surety pending the outcome of his filing.

On August 24, 2022, he was convicted and fined RM3,500 in default two months imprisonment by Kuala Selangor magistrate’s court.

He was also ordered to pay RM500 in costs to the prosecution.

According to the facts of the case, Mohamad entered the house of his aunt, Suhaida Sulaiman, in Sungai Sireh, Tanjong Karang, Kuala Selangor, at 4.30am on February 12, 2019.

He subsequently entered her room and covered her mouth with his hand. Her 10-year-old daughter, who had been asleep in the same bed, screamed and he fled the scene.

The prosecution then appealed the sentence to the High Court, which on January 31 imposed a six-month jail term. It also maintained the RM3,500 fine and prosecution costs.

Mohamad was represented by lawyer Maidzatul Akmal Daud, while deputy public prosecutor Mohd Fairuz Johari appeared for the prosecution. – Bernama, April 13, 2023.
