THE act of uploading and spreading obscene content is an offence under Section 233 of the Communications and Multimedia Act.
Communications and Digital Deputy Minister Teo Nie Ching advised all parties to be more careful when uploading or sharing any content on social media.
“If we refer to Section 233 of the Communications and Multimedia Act, it is stated that the improper use of network facilities or services is indeed an offence, for example, obscene, menacing or offensive content.
“If someone uploads such content through social media, he or she can be investigated under Section 233 of the Communications and Multimedia Act,” she told reporters after a breaking fast event at Felda Bukit Batu community hall in Kulai today.
She was asked about the spread of a video of a young couple allegedly engaging in an indecent act in a car.
Teo, who is also Kulai MP, said that the ministry through the Communications and Multimedia Commission (MCMC) would cooperate with the Royal Malaysia Police (PDRM) to identify individuals who upload inappropriate content.
“We have asked the MCMC to investigate people who have misused the internet to upload and spread such content,” she said.
Under the Act, those convicted can face a maximum fine of RM50,000, or imprisonment of up to a year, or both. – Bernama, April 9, 2023.
