TWO Christians in Sabah failed in their bid today to reinstate a suit against Abdul Hadi Awang over an allegedly seditious statement after the Federal Court struck out their leave application.
Hadi was alleged to have insulted the followers of the Christian faith.
A three-person bench chaired by Chief Judge of Malaya Mohamad Zabidin Mohd Diah today unanimously allowed a preliminary objection raised by Hadi’s counsel Yusfarizal Yussof.
Maklin Masiau and Lawrence Jomiji Kinsil@Maximilhian sought leave to revive a civil action which the Kuala Lumpur High Court struck out in 2021 and which the Court of Appeal upheld last year.
The pair’s counsel R Kengadharan told the court that he had great difficulty contacting the deponent, who lives in Labuan, and who did not affirmed the appeal leave application.
The bench also comprised Federal Court judges Mary Lim Thiam Suan and Harmindar Singh Dhaliwal. – April 3, 2023.
