Court orders developer to pay RM9.5 million to 122 Cyberjaya home buyers

THE Kuala Lumpur High Court today ordered a housing developer to pay RM1.35 million for late delivery and RM2 million in aggravated damages to 112 buyers in a Cyberjaya housing project.

In addition to this, Judge Akhtar Tahir ordered developer Wawasan Rajawali Sdn Bhd to pay RM50,000 to each buyer, which works out to RM6.1 million in the project for misrepresentation.

The home buyers had taken Wawasan Rajawali, a subsidiary of OSK Property Holdings Sdn Bhd, to court after finding discrepancies between what was promised in the project brochure and what was delivered.

The project was promoted as a mixed development with housing and a shopping complex, hotel and park.

But it did not turn out as envisaged in the brochure.

Judge Akhtar, who delivered the judgement online, also ordered Rajawali to rectify defects within three months from today.

The buyers were represented by V. Rajadevan of Rajadevan & Associates while Wawasan Rajawali Sdn Bhd was represented by Andrew Chiew of Lee Hishammuddin Allen & Gledhill.

Rajadevan said it was a long awaited victory for the plaintiffs who filed the suit in 2019. – November 3, 2022.
