Zuraida fails to quash PKR's RM10 million lawsuit


The Court of Appeal has ruled that PKR’s suit against former vice president Zuraida Kamaruddin must go to trial, as the party seeks to recover a RM10 million bond. – Facebook pic, September 6, 2022.

THE Court of Appeal today dismissed former PKR vice president Zuraida Kamaruddin’s appeal to strike out a lawsuit filed against her by the party for breaching a bond agreement.

A three-member panel, led by Justice Vazeer Alam Mydin Meera, in a unanimous decision said the court agreed with the High Court judge that the issue of the legality and validity of the contract between Zuraida and PKR could only be determined through a full trial.

“The court needs to hear full evidence, both documentary and orally, before a decision is made. We do not find that the High Court judge was clearly wrong, hence the appeal is dismissed with cost RM10,000 and the decision of the High Court is affirmed,” Justice Vazeer said in his decision.

He was joined on the bench by M. Gunalan and Mariana Yahya.

The panel made the ruling after hearing submissions from counsels Muhammad Nizamuddin Abdul Hamid, representing Zuraida, and Ranjit Singh, who appeared for PKR secretary-general Saifuddin Nasution Ismail.

On November 19, 2021, the High Court dismissed Zuraida’s application to dismiss the suit filed by the party on September 28, 2020.

PKR alleged that Zuraida had signed a RM10 million bond on April 25, 2018.

Among the terms and conditions were that by appearing as a PKR candidate and using party’s logo, emblem, symbol, and flag had increased her personal wealth by the above sum.

According to PKR, the bond guaranteed that Zuraida would refund the sum if she left the party, joins other political parties or becomes an independent elected representative.

The party alleges Zuraida broke the terms of this agreement when she left to join Bersatu. – Bernama, September 6, 2022.
