Federal Court hearing Najib’s bid to force retrial of SRC case

CHIEF Justice Tengku Maimun Tuan Mat and four other judges are hearing former prime minister Najib Razak’s application to introduce new evidence in his SRC International Sdn Bhd case and thus seek a retrial.

Today, the court is scheduled to hear counsel for Najib argue recent discovery that the trial judge Mohd Nazlan Mohd Ghazali was in 2006 the general counsel and company secretary for Maybank Group.

The panel – which also includes Chief Judge of Sabah and Sarawak Abang Iskandar Abang Hashim and Federal Court judges Nallini Pathmanathan, Mary Lim and Mohamad Zabidin Mohd Diah – will hear counsel say that Nazlan had the overall responsibility for the management and administration of all legal departments within the entire group.

If Najib fails to convince the panel, the Federal Court is expected to proceed with his appeal against his conviction and sentence handed down by Nazlan on July 28, 2020.

Najib was sentenced to 12 years in prison and a fine of RM210 million, which was stayed pending the outcome of his appeals.

Najib, 69, is represented by lawyer Hisyam Teh Poh Teik, Zaid Ibrahim, Liew Teck Huat and M. Rueben, while the prosecution is led by ad hoc prosecutor V. Sithambaram, who is assisted by deputy public prosecutors Donald Joseph Franklin, Sulaiman Kho Kheng Fuei, Mohd Ashrof Adrin Kamarul and Manjira Vasudevan. – Bernama, August 15, 2022.
