Prosecution failed to establish time of alleged murder, says Samirah’s lawyer

PROSECUTORS could not establish the exact time of Nazrin Hassan’s alleged murder, which led to the acquittal of his widow Samirah Muzaffar and two teenagers today, lead defence counsel Muhammad Shafee Abdullah said.

Commenting on Justice Ab Karim’s exoneration of the trio, Shafee said the time stated by the prosecutors was not concurrent with the findings of Hospital Kuala Lumpur forensic medicine consultant Dr Siew Sheue Feng.

Siew in her autopsy report had stated the murder occurred between 11pm on June 14 and 4am, June 15, but prosecutors concluded that the crime took place between 11.30pm on June 13 and 4am the next day.

“Justice Ab Karim decided that there were not enough statements to support the evidence presented by the prosecution,” the lawyer told reporters after the verdict today.

“The time of the alleged murder stated by the Dr Siew was way beyond the time suggested by the prosecution,” Shafee said.

“The judge decided that the accused could not be placed at the scene (at the time of the murder)… and there are other things that were inconclusive.”

Shafee added prosecutors also failed to establish that Samirah, two teenagers, whose names were withheld because of their age, and an Indonesian maid, who is still missing, were at the crime scene at the time of the alleged murder.

“There were four suspects, including a maid who is still at large.

“All four could not be placed at the crime scene,” he added.

Earlier today Justice Ab Karim acquitted the widow of Nazrin, and two teenagers of the 2018 murder of the Cradle Fund Group CEO.

The judge said the prosecution did not establish a prima facie case against the trio.

Samirah and the two teens were accused of killing Nazrin on June 14, 2018, and of subsequently attempting to cover up the murder by setting the house on fire.

Meanwhile, Nazrin’s brother, Dr Aziz Hassan said he hoped the prosecution would appeal the verdict.

He said his family are not out to seek revenge but justice for his brother.

“For Nazrin and for the sake of justice, we hope that they will appeal against the verdict today. God willing, truth will prevail. This is not an issue of seeking revenge, we accept that Nazrin is dead but we want to know who did this to him.”

“We want to know the truth; that is why we hope they will appeal and if they do not appeal we will have to request for an inquest,” said 62 year old Aziz.

Nazrin’s sister, Che Elainee Hassan, who was visibly upset at the outcome of the trial, said she wanted justice for her younger brother.

“We are not here to get someone to be hang. We just want justice to be served. We leave this to God,” she said.

On whether the defence is prepared for an appeal, Shafee said the team is ready.

“We stand to win and we are ready. Our submission alone takes three to four days. If they appeal, we have another chance to state more reasons,’ he said. – June 21, 2022.
