High Court throws out push for judicial review of Covid vaccine

THE High Court in Kuala Lumpur has overturned a ruling by the Court of Arbitration to allow 10 people dissatisfied with their Covid-19 vaccination to file for a judicial review of the government’s national immunisation policy.

Judge Amarjeet Singh dismissed the application after he was satisfied that the Court of Arbitration had no jurisdiction to register the award.

The plaintiffs claimed that the implementation of the policy resulted in deaths, adverse events following immunisation (AEFI) and discrimination against those who refused the vaccine.

However, lawyer Mohamad Zainuddin Abu Bakar, representing the plaintiffs, told reporters that Amarjeet suggested that they could file for judicial review directly to the High Court, according to correct procedure.

On March 30, the plaintiffs applied for the right to register the judicial review dated March 3, 2022, granted by the Court of Arbitration.

They also sought to include claims and list the names of the respondents.

In an affidavit in support of the application, Zainuddin said all plaintiffs had received an award from the Kuala Lumpur Court of Arbitration, which ordered the filing with the High Court. – Bernama, May 30, 2022.
