Rights group says Singapore must not hang Malaysians pending judicial review

SINGAPORE must not execute two convicted drug traffickers tomorrow as planned until the duo have exhausted all their legal avenues, rights advocate Lawyers for Liberty said.

Lawyers for Liberty coordinator Zaid Malek said the Singapore Court of Appeal had heard an urgent application today by Malaysian citizen Pausi Jefridin and Singaporean Roslan Bakar for an order to review their death sentence and halt their execution.

“Although the application was dismissed this afternoon, a fresh judicial review application has been filed on an urgent basis this evening to prohibit the hangings of Pausi and Roslan.

“This pending application must be heard by the Singapore courts, and no execution must be carried out until this legal process is exhausted,” said Zaid in a statement.

He also urged the Singapore government and the judicial authorities to ensure that the execution scheduled tomorrow does not take place in view of Pausi and Roslan’s rights to pursue their pending legal actions to the conclusion.

“We emphasise that if Singapore proceeds with the execution despite the pending judicial review application, it will be a blatant denial of due process to Pausi and Roslan, as well as a flagrant breach of international human right norms, said Zahid.

Pausi, who is Sabahan, and Roslan, both with low IQs, had been found guilty of drug trafficking.

They were found smuggling diamorphine weighing 96.07g and methamphetamine weighing 76.37g in 2010.

According to Singaporean journalist Kirsten Han, court documents show that Pausi’s IQ was assessed to be 67.

“Pausi’s family, from Malaysia, will only have three days to see him before execution,” she tweeted.

Besides Pausi, another Malaysian, Nagaenthran K Dharmalingam, is also on death row.

Nagaenthran has been diagnosed with an intellectual disability and has an IQ of 69, which is lower than average.

Nagaenthran had filed two applications last month in an attempt to halt his death sentence.

Singapore’s Court of Appeal is scheduled to deliver its decision at the end of the month. – February 15, 2022.
