Hands off Taman Rimba Kiara until court appeal completed, TTDI residents tell developer, City Hall

THE developer and other related parties of the proposed Taman Rimba Kiara project must not touch the site pending their appeal against the nullification of the development order at the Federal Court, Taman Tun Dr Ismail (TTDI) residents said today.

The parties, developer Menang Perkasa Sdn Bhd, Kuala Lumpur City Hall (DBKL) and Yayasan Wilayah Persekutuan, were today granted leave by the Federal Court to appeal against the Court of Appeal’s decision to quash the condominium project’s development order.

The appellate court’s decision is still binding, the TTDI Residents’ Association (TTDI RA) reminded the parties concerned.

“The condo development order continues to be null and void, and we caution DBKL, the FT Ministry and/or any other parties against attempting any steps that may compromise the condition of Taman Rimba Kiara pending completion of the appeal process,” TTDI RA chairman Abdul Hafiz Abu Bakar in a statement.

Hafiz said residents are confident that upon further examination, the Federal Court will uphold the decision of the Court of Appeal, which nullified the development order after finding that it did not comply with the applicable rules and procedures.

“The TTDI RA notes the granting of limited permission by the panel to pursue the appeal before the Federal Court. For clarity, today’s proceedings were only focused on whether to grant permission to pursue the appeal, and to what extent.

“The appeal itself is yet to be heard and will be scheduled for a date in the future. 

“We note that the Federal Court panel thought there were specific, limited issues of law which had been brought up in the course of the case so far, which merited further examination and analysis at the Federal Court,” Hafiz said.

The Court of Appeal on January 27, 2021, decided that the development order obtained in 2017 by the joint venture of Yayasan Wilayah Persekutuan and developer Memang Perkasa for the Taman Rimba Kiara project, was null and void.

Memang Perkasa is a subsidiary of Malton Bhd.

The Kuala Lumpur mayor, Yayasan Wilayah Persekutuan and Memang Perkasa had appealed against the decision.

TTDI RA is represented by a legal team comprising Gurdial Singh Nijar, Aliff Benjamin Suhaimi, Christopher Leong, Abraham Au, Phoebe Loi and Charles Chong.
