THE Kuala Lumpur High Court will deliver its decision on September 9 on Rosmah Mansor’s bid to nullify her RM1.25 billion solar hybrid project corruption trial and to disqualify Gopal Sri Ram as the lead prosecutor in the case.
Judge Mohamed Zaini Mazlan said he would be delivering his decision on that day after hearing submissions from both the defence and prosecution on Monday and today.
The prosecution submitted today that Rosmah’s application to render the trial null because of Sri Ram’s appointment made on May 21 in retrospect was irrelevant.
Sri Ram, who appeared together with Ahmad Akram Gharib, said there was no issue as to the impropriety of his appointment as it has been held valid by the Court of Appeal and Federal Court.
The defence had contended that Sri Ram’s appointment letter issued by the current Attorney-General Idrus Harun dated July 8, 2020 and another one dated May 21, 2021 was a desperate measure to have the appointment legalised.
The defence called the appointment of Sri Ram illegal, irregular and defective as it was dated after the start of the trial. Rosmah was charged in court on November 15, 2018.
The judge also allowed both parties to file affidavits in support of their arguments before the decision is made.
On February 18, Zaini ordered Rosmah to enter her defence on all three corruption charges related to the solar hybrid project for 369 rural schools in Sarawak.
The solar trial has seen 23 prosecution witnesses testify since proceedings began on February 5 last year and ran about 34 days.
Rosmah, 69, was not present in court today. – July 15, 2021.
