A GROUP of Gombak voters are suing their MP, Mohamed Azmin Ali, for deceit and breach of fiduciary duty over his role in toppling the Pakatan Harapan government and forming its replacement, Perikatan Nasional.
The suit was filed by 10 voters in the constituency through Messrs Yohendra Nadarajan at Kuala Lumpur High Court last week, Free Malaysia Today reports.
The plaintiffs want several declarations: that Azmin owes them a fiduciary duty as an elected representative, that he had committed the tort of deceit, and that he had violated his constitutional oath.
They are also seeking damages and other orders deemed fit by the court.
The plaintiffs have accused Azmin – formerly the economic affairs minister under the previous administration and now minister for trade and international industry – of making false representation by standing for election in 2018 on a platform of ousting the then Barisan Nasional coalition.
They said Azmin had also said that he promised to free Malaysia of corrupt officials.
However, Azmin is widely believed to be the architect of the collapse of the PH government in February when he left PKR to join other parties, including BN, in forming the Perikatan Nasional government.
The plaintiffs said that in doing so, Azmin had broken his pledge to abide by the PH 2018 election manifesto.
He had also called then prime minister Najib Razak, Umno and BN “enemies” and described their supporters as “traitors”. – December 1, 2020.
