MIGRANTS who buy or possess fake MyKad, which is an offence under the Immigration Act 1959/63, can be prosecuted under the Security Offences (Special Measures) Act 2012 (Sosma).

Home Minister Hamzah Zainudin said at present, those who commit such offences are only detained under the Immigration Act and then repatriated.

“(Prosecution under Sosma) will be implemented soon. It does not require an amendment to the law,” he told the press during a visit to the National Registration Department (NRD) in Putrajaya today.

“The home minister has the authority, under the First Schedule of Sosma, to increase the number of Immigration Act offences that are included in Sosma.”

He said 37 migrants found to be in possession of fake MyKad were detained up to Friday in NRD operations conducted nationwide.

Hamzah said Malaysians involved in syndicates that falsify MyKad also face action under Sosma, adding that investigations will be carried out following 12 recent arrests.

He said the ministry is in talks with several companies on developing digital identity cards to combat the issue of fake MyKad. – Bernama, July 20, 2020.
