Court to decide Dr Mahathir chairman bid along with main suit

THE Kuala Lumpur High Court will decide on an interim order application by Dr Mahathir Mohamad to be recognised as Bersatu chairman together with his main suit against the party. 

It decided similarly on an application by Mukhriz Mahathir to be recognised as deputy president.

Both men, as well as former youth chief Syed Saddiq Syed Abdul Rahman, former supreme council members Maszlee Malik, Amiruddin Hamzah and former secretary-general Marzuki Yahya, filed an interim injunction to prevent the party from altering its constitution during the legal dispute among others.

This is on top of a suit filed on June 9, disputing their loss of membership. 

Justice Rohani Ismail set July 9 to hear the applications for the interim injunction orders.

The court will also hear on the same date an application by Bersatu president Muhyiddin Yassin to dismiss the suit against the loss of party membership.

“Today was to hear various interim injunctive orders applications,” said Dr Mahathir’s lawyer Mohamed Haniff Khatri.

He said the hearing for Dr Mahathir’s application for an interim injunction against Muhyiddin had to be postponed because the defendants needed time to put in their affidavit and submissions.

“We sought an ad interim order that the status quo of the parties from today onwards be preserved so that there’s no damage done till the matter can be heard on July 9.

“After hearing arguments, however, the court decided that the ad interim order is not to be done.”

Muhyiddin was represented by Rosli Dahlan. 

The six are suing Bersatu and the Registrar of Societies over their loss of membership from the party.

In their statement of claim, filed on June 9, they accused Bersatu president Muhyiddin and secretary-general Hamzah Zainuddin of conspiring with the RoS to seize power in the party. 

The six were sacked on June 4 for supporting Pakatan Harapan. – June 18, 2020.
