Court clears A-G Thomas of contempt in Adib inquest

THE Shah Alam High Court has cleared Attorney-General Tommy Thomas of contempt for last year’s inquest into firefighter Muhammad Adib Mohd Kassim’s death, reported Free Malaysia Today.

Judicial commissioner Meor Hashimi Abd Hamid dismissed the application by Adib’s father, Mohd Kassim Abdul Hamid, saying it failed to disclose material facts.

“The coroner (Rofiah Mohamad) also failed to consider some of the matters raised by the attorney-general and his officer (Hamdan Hamzah) in their affidavits,” he said in allowing Thomas’ appeal.

Lawyers Ambiga Sreenevasan, Zainur Zakaria and senior federal counsel S. Narkunavathy represented Thomas while Mohamed Haniff Khatri Abdulla appeared for Kassim.

Kassim’s contempt application alleged that Thomas insulted the court through the filing of an affidavit by the Attorney-General’s Chambers on April 3, which indicated that Adib’s death was not caused by injuries sustained.

Adib, 24, died at the National Heart Institute on December 17, 2018 from injuries sustained during the Seafield Sri Maha Mariamman temple riots in USJ, Selangor on November 26 that same year.

Rofiah ruled on September 27 last year that Adib died after succumbing to injuries caused by more than two unidentified persons when he was on duty at the scene of the riot.

She said the blunt force trauma to his chest was not caused by an accident but by two or three persons who had dragged him out of an emergency medical rescue service vehicle. – January 28, 2020.
