AG ‘shocked’ officers disobeyed him over Rafizi appeal

ATTORNEY-General Tommy Thomas said he was shocked today by his office’s apparent disobedience in appealing the High Court’s November decision to acquit Rafizi Ramli of charges under the Banking and Financial Institutions Act, in which the latter was alleged to have revealed bank accounts relating to National Feedlot Corporation.

“It was decided after a discussion I had with Election Commission chairman Azhar Azizan Harun,” he told a news portal, adding that it was his express instruction the Attorney-General’s Chambers would not be appealing and he would take action to that effect on Monday.

“This decision was conveyed to the relevant officers.”

“We will also find out why the appeal was filed when clear instructions were given not to do so,” he said, promising discplinary action.

Rafizi’s lawyer Nik Zarith Nik Moustpha was reported as saying the defence team was notified of the appeal today through an email from the Court of Appeal’s registrar.

Nik Zarith said the registrar has also set March 9 for mention.

On November 15, Shah Alam High Court allowed Rafizi’s appeal to set aside his conviction for violating the act.

Also acquitted was former Public Bank clerk Johari Mohamad, whose lawyer Zaid Malek also confirmed the notification by the court registrar.

On February 7, 2018, Shah Alam Sessions Court found Rafizi, a PKR vice-president, guilty of disclosing documents, comprising balance summaries of bank accounts belonging to National Feedlot Corp, National Meat & Livestock Sdn Bhd, Agroscience Industries Sdn Bhd and Dr Mohamed Salleh Ismail, to media consultant Yusof Abdul Alim and The Star reporter Erle Martin Carvalho.

The exchange took place at the PKR headquarters in Merchant Square, Petaling Jaya, on March 7, 2012.

Johari was charged with conspiring with Rafizi to commit the offence on the same date and at the same address.

The act was later repealed. – December 6, 2019.

  • This is a clear instance of the machinations of the deep state in the AG's Chambers. The AG might want to consider this insubordination as a ground for the dismissal of the rogue member of his chambers.

  • The very fact we had a law against 'data leak' that involved criminal activities like those in NFC, is an encouragement to do many corrupt things. Data leak to fight corruption should be rewarded to make this type of corruption something very evil. Has PH the balls to bell this corruption cat?
