ACTIVIST Jufazli Shi Ahmad, who was arrested by cops in March for allegedly insulting Prime Minister Dr Mahathir Mohamad, is set to sue the government and the police for wrongful detention.
Jufazli said he will be filing his suit after Deepavali.
“I am critical towards the government and my intention is only for them to take action against all sorts of corruption without fear or favour.
“Instead of investigating the bigger fish, the police and the government decided to keep my voice unheard by using intimidating tactics,” he said.
Speaking to The Malaysian Insight, the former DAP member said although he has been freed by the court, and that the incident occurred seven months ago, the police are still harassing him and his family.
“I am still harassed by the police. Just last week the cops called me up to have my statement recorded but my lawyer told me not to comply.
“This was after I lodged a police report about the items they took away from me such as my laptop and mobile phone in March.
“I have also lodged police reports on criminal intimidation I received from certain quarters but the police are more interested to question me rather than to investigate those who have threatened me.
“And until today, there is no case against me. I have yet to be prosecuted for the so-called offences I made. If I had insulted the prime minister why have I yet to be charged? Why are there special branch officers spying on my family,” said Jufazli.
On March 16, Jufazli was arrested for allegedly criticising Dr Mahathir and was later taken to the Dang Wangi police lock-up.
His sister Nurazimah was also arrested for allegedly obstructing the police from detaining Jufazli without an official warrant of arrest.
Jufazli was accused of committing the offence via Facebook where he lashed out at the 94-year-old leader for abuse of power.
Jufazli was remanded for four days from March 16 to 19, and was only allowed to have legal representation on March 20.
He was released after a court rejected an application from the police to extend his detention.
Meanwhile, on October 11, the Kajang Magistrates’ Court acquitted Jufazli’s sister of allegedly obstructing a police officer from arresting her brother at their apartment.
Magistrate Shahrul Zazly Md Zain said the prosecution failed to establish a prima facie case against Nurazimah because the police had no lawful authority when they carried out their duties.
Shahrul was also reported as saying that the police must be armed with the warrants when they were investigating Jufazli under Section 504 of the Penal Code and under Section 233 of the Communications and Multimedia Act.
Section 504 of the Penal Code deals with action against anyone who intentionally insults to cause provocation and disrupt public peace, while Section 233 is for improper use of network facilities.
Nurazimah, 31, was charged with obstructing investigating officer ASP Muhamad Ridzuan Manap when they came to arrest Jufazli at her apartment in Taman Segar Perdana about 3am on the night of the incident. – October 20, 2019.
