SAMIRAH Muzaffar, who is charged with the murder of husband and former Cradle Fund CEO Nazrin Hassan, today filed an application for bail at the Court of Appeal.
The 44-year-old woman made the application through her lawyer Shafee Abdullah who told the bench that Samirah is willing to be placed under a strict bail order as she only wanted to be with her children.
“My client is willing to stay in her house all the times and report to the police station every day,” Shafee told the court.
“She has four children, two are below the age of four.”
However, no decision was made by the bench – Kamardin Hashim. Kamarudin, Rhodzariah Bujang and Mohamad Zabidin Diah – which adjourned the hearing to May 10.
Last month, Shah Alam High Court rejected her bail application on the grounds that Samirah failed to provide reason for bail when she is faced with a murder charge.
She has been locked up since March after being charged at the Petaling Jaya magistrate’s court with the murder of Nazrin. Also charged are two teenage boys who have been released on bail.
During today’s proceedings, Shafee said Samirah has been very cooperative with the police after her remand ended.
“My client was only taken to court 10 months after her husband’s death. Before the charge, she was remanded and then released on police bail but she never tried to escape throughout the period,” he said.
He added high court judge Ab Karim Ab Rahman, was inconsistent in his ruling as he had allowed the two teenagers to be released on bail of RM50,000 each.
“She was denied bail as the lower court believed there will be an attempt to tamper with witnesses but the same court ruled in favour of the two boys who are charged with the same offence.”
Deputy public prosecutor Jamil Aripin argued the Shah Alam High Court judge did not commit any error when offering bail to the teenagers.
“The judge used his discretion when he allowed bail for the two boys and there was no error when he decided to deny Samirah’s bail application,” Jamil said.
The murder trial will start on Sept 3.
Nazrin was initially said to have died due to a phone explosion but Fire Department’s forensic unit found traces of petrol in the room where his body was.
Police reclassified the case as murder and a second post-mortem showed Nazrin had signs of blunt force trauma to his head.
Samirah and the two teenagers pleaded not guilty while police are still looking for another suspect, an Indonesian woman who was said to be the family’s maid.
The Indonesian national was charged in absentia with the trio. – April 26, 2019
