PKR’s Batu Lintang assemblyman See Chee How is leading a team of lawyers in seeking a review of the court proceedings that led to the sentencing of a Kuching man to 10 years in jail and a RM50,000 fine for insulting Islam on Facebook, reported The Star today.
See’s team comprises lawyers Francis Teron, Desmond Kho, and Jeffery Mok.
See said they are unsure if the the Kuching Sessions Court that sentenced 22-year-old Alister Cogia had taken his alleged psychiatric condition into account.
Alister pleaded guilty before Sessions Court judge Jason Juga on Friday to uploading offensive materials on Islam and Prophet Muhammad in his Facebook account.
His family had sought the lawyers’ help, claiming Alister was suffering from behavioural difficulties and required psychiatric advice and therapy.
Alister’s mother, Alen Rigod, also claimed she and members of his family were also denied permission to meet him while he was under remand.
“He was also not told that he would appear in court last Friday, which caused him to be unrepresented.
“There is doubt whether Alister understood the gravity of the charges and the significance of his guilty plea,” See was quoted as saying.
The lawyers will apply apply for the case to be recalled so that they court could seek the opinion of a psychiatrist.
According to Rigod, Alister was picked up by police two weeks ago but was released without being charged.
She said the police returned on March 3.
“We were unsure what he did in his room or online. But we found out later that he has multiple Facebook accounts where he had posted some weird comments,” she was reported as saying. – March 11, 2019.
