THE Shah Alam High Court today allowed for Cradle Fund CEO Nazrin Hassan’s remains to be exhumed after reviewing a previous order made by the magistrates’ court.
High court judge Ab Karim Ab Rahman said while the magistrate courts’ order for exhumation was right, it was nevertheless made under the wrong legal provisions.
As such, the judge varied the order and allowed for the exhumation to proceed.
This afternoon, Nazrin’s widow, Samirah Muzaffar, sought the court’s ruling for clarification to the first order allowing the exhumation.
Samirah made the application after the Petaling Jaya magistrates’ court on Monday allowed the police to exhume the remains.
The application was made by the police after Nazrin’s brother, Dr Malek Hassan, lodged a report, urging the authorities to conduct a second post-mortem, alleging that the findings of the first autopsy were flawed.
He said the magistrate had treated the original application as though it was part of an inquiry. However, the matter was still under police investigations.
“The high court judge agreed with us and amended the magistrate’s order,” he said.
All the parties agreed with the court’s ruling today to allow for the exhumation and second post-mortem, he said.
Nazrin was found dead after his bedroom at a double-storey terrace house in Mutiara Damansara caught fire on June 14, a day before Hari Raya.
His family previously said his handphone had exploded, causing the blaze. Cradle Fund also issued a statement, saying its CEO died from blast injuries attributed to an exploding handphone being charged next to the bed.
Malek, who saw Nazrin’s body after the first post-mortem, told The Malaysian Insight he noticed a wound on the left side of the head that was too big and deep to have been caused by a blunt object like a handphone.
“The injury to Nazrin’s head could only have been caused by a sharp object, as the wound was deep,” Malek said.
Police arrested Samirah, a senior executive at the Malaysian Intellectual Property Corporation, her former husband, their two teenage sons, Nazrin’s sister-in-law and her husband. They have been released on bail.
All the suspects are from the widow’s side of the family. – October 4, 2018.
