ROSMAH Mansor has once again filed an application to challenge the appointment of Gopal Sri Ram as senior deputy public prosecutor in her RM1.25 billion solar hybrid project corruption trial and nullify the entire trial.
The 70-year-old filed the judicial review application through Messrs Akberdin & Co at the High Court on Friday, naming the attorney-general (AG)/public prosecutor, the government and Sri Ram as respondents.
Ex-prime minister Najib Razak’s wife earlier filed a similar application at the Criminal High Court in Kuala Lumpur.
But her application was dismissed by the High Court and her appeal against the court ruling was also dismissed by the Court of Appeal and the Federal Court.
Rosmah, in her latest application, sought to declare that the appointment of Sri Ram as senior deputy public prosecutor was unlawful through three letters of appointment (fiat) dated July 8, 2020, and May 11 and 21, 2021, respectively.
She sought to declare that the first version of the fiat signed by AG Idrus Harun on July 8 is invalid, as it should have been signed by the previous AG on or before November 15, 2018, i.e. the date of prosecution against the applicant.
She sought to declare that the second version of the fiat is non-existent as Tommy Thomas in his book stated that Sri Ram’s appointment is related to 1Malaysia Development Bhd and not her trial, as well as sought to declare that the third version of the fiat shows that the appointment is defective.
“Therefore, I, as the accused, must be acquitted of all charges under section 16(a)(A) of the Malaysian Anti-Corruption Commission Act 2009 in the solar case.”
Rosmah’s lawyer, Akberdin Abdul Kader, said his client’s application will be heard before judge Ahmad Kamal Md Shahid on June 30.
Rosmah is charged with soliciting RM187.5 million and two counts of receiving bribes of RM6.5 million from Jepak Holdings Sdn Bhd’s former managing director Saidi Abang Samsuddin through her former special officer, Rizal Mansor.
Judge Mohamed Zaini Mazlan has set July 7 to deliver the ruling on whether to acquit or convict the accused on the three corruption charges. – Bernama, June 27, 2022.
