SM Faisal’s ex-wife to serve 7-day jail sentence from today


EMILIA Hanafi, the ex-wife of businessman SM Faisal SM Nasimuddin Kamal, will serve a seven-day jail sentence at a prison in Kajang from today for failing
to comply with a court order on visitation dates for her three children.

The Shariah High Court on September 4, 2019, sentenced her to seven days’ jail for contempt of court, after she disobeyed an order by unilaterally rescheduling the visitation dates for her three children, aged 10 to 16. But she was released on a RM5,000 bail pending appeal.

Emilia, 43, clad in a white shawl and long dress, arrived at the Kuala Lumpur Shariah Court at 9.50am. She was accompanied by her lawyer, Nazri Yahya,
and family members.

Nazri told reporters that his client is mentally ready when she surrendered at the police office of the court today.

Emilia will appear at the magistrates’ court in Kuala Lumpur on July 6, for a case involving SM Faisal, 43, who is alleged to have injured his ex-wife.

The couple married in 2002 and divorced in 2016. Emilia was granted full custody of their three children, with SM Faisal given visitation rights.

Emilia filed a judicial review application to challenge the jurisdiction of the Shariah Court, which sentenced her to seven days’ jail for contempt of court.

Emilia filed the application through Messrs Nizam Bashir & Associates at the High Court, and named as respondents SM Faisal, his 70-year-old mother Zaleha Ismail and five others.

She sought a declaration that the Shariah High Court and Shariah Court of Appeal do not have jurisdiction to hear and punish any individual who contravenes the court as it is the exclusive right of the civil courts at the levels of the High Court, Court of Appeal and Federal Court, according to article 126 of the Federal Constitution.

The judicial review application will be heard before High Court judge Ahmad Kamal Md Shahid on July 20. – Bernama, June 27, 2022.
