CONTROVERSIAL cartoonist Mohd Fahmi Reza Mohd Zarin’s court case is not over, as the deputy public prosecutor will be appealing his case after the high court waived his imprisonment and fined him.
Lawyer Syahredzan Johan said that they were served a notice of appeal from the deputy public prosecutor on December 9 and his client would be appealing the case.
“On our part, the sentence given by the court is reasonable.
“We will meet the public prosecutor’s appeal and hope to get a favourable decision,” he told The Malaysian Insight.
Last month, the high court set aside the graphic designer’s fine and jail sentence for uploading an “offensive” caricature of former prime minister Najib Razak on Facebook.
Judicial commissioner Mohd Radzi Harun allowed the appeal from Fahmi, 40, who was convicted and sentenced to three months’ jail and fined RM30,000 for the offence by the sessions court in February.
Radzi reduced the fine to RM10,000, in default of a month’s jail.
The judge said the court was satisfied that the prosecution had succeeded in establishing the facts without a reasonable as provided under Section 233(1)(a) of the Communications and Multimedia Act 1998.
Radzi said the court also took into consideration media reports of statements by Communications and Multimedia Minister Gobind Singh Deo proposing to do away with the draconian elements in the Communications and Multimedia Act, including in Section 233. – December 19, 2018.
