THE court battle over who is the rightful Sabah chief minister was prolonged today when the Sabah High Court postponed former Sabah chief minister Musa Aman’s originating summons.
The ruling was made because of the pending decision to Parti Warisan Sabah’s president Shafie Apdal’s application to strike out the originating summons.
High Court judge Yew Jing Kee set September 3 to deliver her decision on the application, and counsels were told to file in their submission.
Shafie is represented by Douglas Lind while Musa is being represented by Tengku Fuad Tengku Ahmad.
Tengku Fuad said the process had just started and it is a long way before the court battle will be concluded.
“So we have a long way to go here and we’re not even passed the first stage yet.
“If the striking out is granted, of course, we will appeal and if not, we will go full out on the originating summons,” he told reporters after the court mention today.
Musa filed a writ of summon on May 17 but cancelled it and replaced it with an originating summons on June 6.
Shafie filed the objection to the original summons on June 5.
Musa is laying claim to be the rightful chief minister of Sabah after the May 9 elections.
The Sabah Barisan Nasional chairman was sworn in on the night of May 10 with a simple majority, but barely 36 hours after the appointment, he lost his majority due to the crossing over of several assemblymen over to Warisan.
Shafie was then sworn in on May 12 as the chief minister. – July 9, 2018.
