PKR’S Rantau candidate Dr S. Streram has filed an RM7.6 million suit against the Election Commission and returning officer Amino Agos Suyub for preventing him from contesting the Negri Sembilan state seat.
The misfeasance in public office suit was filed by his lawyer, Mohamed Haniff Khatri Abdulla, at the Kuala Lumpur High Court this afternoon.
Streram said that the commission and Amino failed in their responsibilities under the Election Commission Act 1958 by not allowing him to contest the seat despite having an appointment letter from his party and paying the RM8,000 deposit.
Streram said he paid RM5,000 for his candidacy and RM3,000 for campaign materials on April 25. He said he was told that an EC pass would not be required to enter the nomination centre.
The EC declared that caretaker Negri Sembilan menteri besar Mohamad Hassan had won the seat about 11am on April 28.
Haniff said the suit was aimed at sending a message to the commission.
“Public officers must realise that if they wish to work in cahoots with caretaker prime minister Najib Razak’s regime unlawfully and by abusing their powers… those officers also run the risk of facing suits of misfeasance,” Haniff said.
“This is intended to be a warning to all public officers until a new government is sworn in after May 9.” – May 7, 2018
