Motorists must still pay summonses, says Penang council

All summonses for illegal parking issued under the Road Transport Order (Car Parks) 2014 remain enforceable, says the Penang Island City Council. – The Malaysian Insight pic, May 18, 2017.

AFTER losing a parking summons case in court earlier today, the Penang Island City Council (MBPP) said it does not mean all other errant motorists with summonses are off the hook.

In a statement this afternoon, the council said the court’s decision today had no bearing on other cases of illegal parking.

“Each case has different facts and merits. The council will also appeal against the court’s decision today,” MBPP said.

The council also denied rumours now viral on social media, which claimed that MBPP has no right to issue summonses.

“That is not true. All summonses issued under the Road Transport Order (Car Parks) 2014 remain enforceable.

“The council will continue to enforce and take action against those who fail to pay their parking summonses,” MBPP said.

The council lost its case this morning when magistrate Mohamad Amin Shahul Hamid ruled that the summons issued to lawyer and former Batu Uban assemblyman S. Raveentharan was invalid.

The magistrate said Raveentharan was not informed of his offence and was not allowed to make a representation when the summons was issued.

Raveentharan, who was charged with parking illegally on Jalan Tun Syed Barakbah three years ago, was freed of the charge without having to enter defence.

His lawyer Baljit Singh said the decision in his client’s case might have an impact on other summonses issued by the council in the same manner. – May 18, 2017.
