A MAN whose fight with his older brother resulted in the latter’s death has claimed trial to the charge of culpable homicide not amounting to murder.
Lim Liang Haw, 48, pleaded not guilty when the charge was read to him in Mandarin at the magistrate’s court in Bukit Mertajam today.
On Sunday about 7.30am, Liang Haw had fought with his brother Poh Haw, 59, in front of the former’s house in Sama Gagah, Permatang Pauh.
Liang Haw is accused of assaulting his brother while knowing his action could cause Poh Haw’s death.
He faces jail time of up to 10 years or a fine, or both, if convicted under Section 304(b) of the Penal Code.
He was represented by lawyer RSN Rayer while deputy public prosecutor Kamaliza Md Zin appeared for the prosecution.
Rayer said his client had made several police reports out of fear for his family’s safety after he was visited at home by an armed and violent Poh Haw.
In the reports, Rayer said his client had stated that Poh Haw had run amok with machetes and a pickaxe in front of Liang Haw’s home.
Magistrate Jamiliah Abd Manap set bail at RM10,000 and ordered Liang Haw to report to the nearest police station once a month.
She fixed July 17 for document submission. – May 18, 2017.
