Prosecution in Jong-nam trial to present footage of practice attacks

AIRPORT closed-circuit television (CCTV) camera footage of Kim Jong-nam murder accused Doan Thi Huong carrying out what prosecutors allege to be a practice run two days before the assassination of the North Korean leader’s half-brother will be presented as evidence tomorrow.

Investigating officer Azirul Nizam Che Wan Aziz told the court today that police have 23 DVDs of CCTV footage, including the “attack”, which will be presented as evidence.

Gooi Soon Seng, representing second accused Siti Aisyah, told reporters that his client would not be in the videos. 

The footage on the DVDs include one of Doan appearing to be smearing something on a person’s face two days before Jong-nam died, deputy public prosecutor Wan Sahaharuddin Wan Ladin told reporters at the Shah Alam High Court today.

Jong-nam, the half-brother of North Korean leader Kim Jong-un, died on February 13 after being smeared with what authorities said was VX agent, a chemical classified as a weapon of mass destruction.

It is believed that the women had smeared on Jong-nam two seperate percusor liquids that when combined would produce the lethal nerve agent that killed the North Korean within minutes.

Investigating officer Azirul Nizam Che Wan Aziz told the court today that police had 23 DVDs of CCTV footage, including the “practice attack”, which would be presented as evidence.

Lead counsel for Doan, Hisham Teh Poh Teik disputed the word “attack” used by Azirul.

“He may say it is an attack, but that is for the court to find,” Hisham told reporters after the afternoon session today. 

“The court must make a finding at the end of the case,” he said, adding that judge Azmi Ariffin agreed to strike out the comment from Azirul’s oral evidence. The judge also struck out the word “latihan” (practice) after an objection from Doan’s defence lawyers, he added. 

Hisham said the defense would argue that Doan did not knowingly carry out the murder of Jong-nam, as she would have otherwise behaved differently.

“So, all Doan knew it was an oily substance on her hands and that was all.”

“That is the core of our case, that Doan had no knowledge whatsoever, that the liquid applied on the palm was (part of) a dangerous weapon, or chemical weapon. She never knew that.”

Naran Singh, who is also Doan’s counsel said if “Doan knew this, she would have washed her hands thouroughly”. 

“Secondly, the same T-shirt was worn the next day (after Kim’s death). If you knew that there was a toxin on you, you would wash your hands thoroughly. You would not wear the same T-shirt. You would not come back to the airport the second day… proving that she’s innnocent. 

Gooi said the footage on the DVDs did not include his client, second accused Siti Aisyah.

“As far as the DVDs are concerned, from what we’ve seen, they’ve already said they could only see Doan applying (the liquid). They have not given evidence my client (Siti) applied (on anyone).

“They found two DVDs, one Doan applying (chemicals) on a random person in what they alleged was a practice. Whether it was a practice or a prank, it’s left to the court to decide.”

“The burden is upon them to unfold their case. So far, they have no shown that symptoms on my client, or on Doan. They have not proven there were symptoms. It is not for us to disprove there were symptoms.

“If it’s impure it would need higher dosage. They would need to prove what was the quantity used.

“They found US$38,000 on the scientist (North Korean chemist Ri Jong Chol). If you see that money on him, why didn’t you send it for analysis to verify for VX. Whereas the few dollars on Siti Aisyah you sent to check for VX.”

Gooi also claimed that the North Korean chemist’s house was not checked for traces of the chemical.   

“His house could have been a clandestine lab. If you could find the VX in Ri Jong Chol’s house, then that means that they (the North Koreans) were the suppliers and they are the persons who made the VX.” – October 10, 2017.
