Adib’s family counsel apply to cite AGC for contempt

LAWYERS today filed an ex parte application on behalf of fireman Muhammad Adib Mohd Kassim’s family to have the Attorney-General’s Chambers (AGC) cited for contempt of court.

The family’s counsel, Mohd Zubir Embong, said an affidavit filed in April by the AGC contained premature presumptions about Adib’s case.

One such presumption was a statement that Adib’s injuries were not from him being beaten up, Zubir told an inquest into the death of the fireman following the riots at a Subang Jaya temple last November.

“The affidavit that was given to the Court of Appeal to address the Seafield Mariamman temple’s application (to hold a watching brief during the inquest) stated that Adib’s injuries were not due to him being beaten.

“The (A-G) gave the reason for Adib’s death before the coroners’ court revealed its findings.”

In April, the Save Seafield Mariamman Temple Task Force withdrew its appeal at the Court of Appeal against the coroners’ court’s dismissal of its application to hold a watching brief.

Lawyer M. Visvanathan, representing the task force, said he informed the appellate court that the temple was withdrawing its application based on the affidavit filed by the AGC on April 3.

He said the affidavit, affirmed by deputy public prosecutor Hamdan Hamzah, stated that Adib’s death was not due to a beating, and that a forensic pathologist had testified during the inquest that the injuries sustained by the fireman, which led to his death, were not due to him being beaten up.

Zubir said the A-G will have to respond to the family’s application, which was served today.

“We have served the application to the A-G’s representative, lawyer Faten Hadni Khairuddin.

“The coroner (Rofiah Mohamad) will address the ex parte application.”

The inquest seeks to determine how Adib sustained the injuries that led to his death 21 days later at the National Heart Institute. – July 16, 2019.
