THE Shah Alam High Court today ordered development firm Persada Istimewa Sdn Bhd to pay Yayasan Selangor RM14 million for failing to develop a piece of land in Klang.
Judge Akhtar Tahir told the developer to pay the foundation RM10 million in general damages, RM3.9 million in special damages and RM100,000 cost.
The judgment was delivered today after a 14-day trial that began on September 20 last year. The plaintive called five witnesses while the defendant called four witnesses to testify.
Yayasan Selangor, a body under the Selangor government, had sued the developer for failing to fulfil terms in their contract, which was inked on March 29, 2004.
The deal involved Persada Istimewa developing a piece of land in Klang owned by the state government.
But the developer had failed to obtain planning permission, vacant possession, move squatters from the land, pay the land premium promised and do the necessary as stated in the agreement.
Yayasan Selangor was represented by lawyers Fahda Nur Ahmad Kamar, Ariffin Haron and Nadiah Zulkifli.
