THE Seafied temple task force wants to ensure all aspects of fireman Muhammad Adib Mohd Kassim’s death are covered, said lawyer M. Visvanathan.
He said this is the main reason why it filed an application for a judicial review on Monday to be made a party in the inquest into Adib’s death, to begin next week.
The application was filed after the coroner’s court barred the task force from being an interested party.
“We need to ventilate what transpired, and how the fireman got injured,” Visvanathan told The Malaysian Insight.
He said if any of the witnesses testify that the riots at the Seafield Sri Maha Mariamman temple last year occurred due to incitement by task force members, lawyers will have the opportunity to question who these members are.
“The entire nation was led to believe that the task force or devotees caused the fireman’s death.
“We need to know whether this is true. It is only fair to all parties concerned.”
Sources have revealed that police are investigating two possibilities in Adib’s death.
One is that he was beaten by rioters, and the other, he was run over by a reversing fire engine.
Sources told The Malaysian Insight that police have questioned at least three firemen, including the driver of the fire truck, who allegedly reversed into Adib while trying to escape the mob at the height of the riots last November.
The task force’s judicial review is expected to be heard at the Shah Alam High Court tomorrow morning.
Visvanathan said the task force’s legal team should get access to all the documents to be produced during the inquest.
“We need to know all the circumstances that led to the incident that caused Adib’s death. So, the task force is an interested party.
“This is pursuant to Section 328 of the Penal Code, that all circumstances must be taken into account when an investigation is conducted via an inquest.”
The inquest begins on Monday, and will go on for 30 working days.
Adib’s family’s lawyer, Mohd Kamaruzaman A. Wahab, said 30 witnesses will be called up, including several firemen.
The Kedah-born Adib was the sole fatality in the violence at the Subang Jaya temple, which erupted after intruders stormed the house of worship on November 26. – February 7, 2019.
