Phee's lawyers to challenge remand order in Kedah

PENANG exco Phee Boon Poh’s lawyers are heading to the Alor Setar High Court tomorrow to find a judge to hear their revision application against the DAP state politician’s five-day remand order.

Lawyers Ramkarpal Singh and R.S.N. Rayer had earlier failed to serve the revision application in Penang.

Ramkarpal said they had attempted to serve the application at the Penang High Court this afternoon but there was nobody around to receive the papers.

They also went to the home of senior Penang high court judge Hadhariah Syed Ismail but could not serve her the papers.

“We will go to the Alor Setar High Court tomorrow and try to see the registrar by 9.15am. Sunday is a working day for them.

“The Alor Setar High Court has the same jurisdiction to hear this matter. This is our only option now since we have failed to serve the papers in Penang.

“This is a crucial matter dealing with a person’s liberty. The remand order was irregular,” he said.

Phee was arrested yesterday by the Malaysian Anti-Corruption Commission (MACC) over some letters he wrote concerning an illegal factory in Sungai Lembu, Bukit Mertajam in his capacity as welfare, caring society and environment exco.

This morning, Penang court senior deputy registrar Ameera Mastura Khamis granted MACC five days more to remand Phee to assist investigations for allegedly using his position for gratification.

The illegal factory’s manager and director, who were also arrested yesterday, are also being remanded for five days.

Ramkarpal said the revision application was also made for the duo, a father and son.

He said Phee’s remand was irregular and illegal as the registrar this morning had made a decision without hearing the lawyers’ arguments. β€“ August 12, 2017.
