THREE voters in Kuala Lumpur’s Bandar Tun Razak have withdrawn their judicial review after the Election Commission agreed to hold a second local inquiry at the parliamentary constituency.

Mohammad Saiful Mansur, Khairuddin Asmuin and Norma Hashim had filed the judicial review in June when the EC refused to hold a local inquiry into the second round of proposals for the redelineation exercise, despite protests by 100 voters in the area.

“On July 27, we received a letter from EC, saying that it would hold a second local inquiry. And this hearing is the basis of our actions.

“If we had not filed the judicial review, EC would not have held a second local inquiry,” said lawyer Syahredzan Johan at the Kuala Lumpur High Court today.

He said judge Kamaludin Md Said allowed the withdrawal of the judicial review without costs.

Syahredzan said this was the third instance of EC refusing to hold a second local inquiry because of a supposed lack of evidence.

“But when we filed a fresh application (for a judicial review) in court, it decided to hold a local inquiry.

“This has happened before in Segambut (and) Setiawangsa.

Shahrul Aman, deputy chairman of electoral watchdog Bersih 2.0, reminded EC not to inconvenience voters.

“In this case, Saiful and his colleagues took it upon themselves as responsible citizens to spend time and money to bring this matter to court.

“But not everybody has the means to do likewise. EC should facilitate the people in the electoral process,” Shahrul said.

Saiful, who is representing Bandar Tun Razak voters, said voters in the constituency had problems when EC proposed the redelineation.

“We informed EC of the issues we faced, like some voters being moved without their knowledge.

“Because EC didn’t pay us any attention, we brought this matter to court with Bersih’s help. Then we got EC’s attention.” – August 1, 2017.
