PAS Batu Division lawsuit against four Amanah members settled amicably


A LAWSUIT filed by Batu PAS chief Azhar Yahya, PAS Batu division and a property owner in Batu district, Md Mansor Ali against four Amanah members went through a mediation process at Kuala Lumpur High Court today.

Judge Ahmad Zaidi Ibrahim recorded the consent judgement in chambers after all the plaintiffs and defendants, Rosden Mohd Yassin, M.Sugaimi A.Rahaman, Ismail Yahaya and Jamhor Nawawi agreed to settle the suit.

In the consent judgement, the parties agreed the third plaintiff (PAS Batu district) would pay RM32,500 to all the defendants within 14 days.

In addition, the Power of Attorney dated August 18, 2015 would be revoked after PAS Batu division paid the money and all the defendants would be required to sign the Revocation of Power of Attorney letter seven days after receiving it.

According to the judgement, vacant possession of the property must be handed over to PAS Batu division immediately after payment was made.

In the suit filed on July 20, 2017, the three plaintiffs applied for a court order to have the defendants surrender the property to them – two shop lots, as well as all expenses and financial transactions involving the property.

The plaintiffs claimed Azhar and PAS Batu division had bought two shop lots in Batu in 2001, for RM250,000 and the ownership of the property was transferred and registered in the name of the first plaintiff (Mansor)  as trustee.

They claimed to pay for the purchase of the property, Mansor applied for a loan from Bank Islam Malaysia Berhad (BIMB), while the second and third plaintiffs paid the monthly instalments. – Bernama, February 22, 2018.
